Terms and Conditions
1. Acceptance of Orders
1.1. All orders are accepted according to these terms and conditions. By using the Studio22 Album Maker Software, website, or Studio22 Online, you accept these terms and conditions.
1.2. Once an order has been processed, uploaded files are retained on the Studio22 Photobook server for three (3) weeks to allow for any necessary quality checks. After this period, files are permanently deleted.
2. Copyright and Content
2.1. All material, designs, and software belong to Studio22 Photobooks. All rights are reserved worldwide. It is strictly prohibited to redistribute, copy, or republish any material or software contained on the Studio22 Photobooks website.
2.2. Words, names, and designs used to identify services or products are considered trademarks, service marks, and/or logos. Customers must not submit copyrighted material belonging to third parties, including but not limited to photographers, artists, publishers, and writers, without proper authorisation.
2.3. Studio22 Photobooks reserves the right to reject any order that contains explicit, obscene, or otherwise inappropriate content. No refunds will be issued for rejected materials.
2.4. The Customer is solely responsible for ensuring that all content they submit complies with applicable copyright laws and other legal requirements related to obscenity, libel, or intellectual property rights.
3. Submission of Print-Ready Files
3.1. Customers who submit their own artwork for printing are responsible for ensuring files meet all print-ready requirements, including correct dimensions, bleed, resolution, and colour profiles.
3.2. While Studio22 Photobooks will make every effort to identify and highlight potential errors, we cannot accept liability for any issues related to content, design, or technical specifications.
3.3. Customers who require a file review for potential errors must book this service in advance. A designer will assess the file and provide a quote based on the complexity of the review. Studio22 Photobooks is not liable for any errors in customer-submitted files unless specifically identified and corrected as part of this paid review service.
4. Use of Software
4.1. The Studio22 Album Maker Software may only be used to design and order photo products offered by Studio22 Photobooks.
4.2. Customers or their representatives may not decompile, modify, reverse-engineer, or create derivative works from the software. Any such actions will be prosecuted to the fullest extent of the law.
5. Liability
5.1. Studio22 Photobooks is not responsible for the loss of uploaded files, incorrect order details provided by the customer, or non-delivery due to third-party shipping errors.
5.2. Studio22 Photobooks cannot be held liable for any discrepancies in colour between product images on the website and final printed products, as online visuals serve as a general reference only.
5.3. Customers are responsible for verifying that images in their designs meet their quality expectations before placing an order. Studio22 Photobooks does not guarantee print quality based on customer-supplied images.
5.4. Studio22 Photobooks shall not be required to produce any content deemed illegal, defamatory, or otherwise inappropriate. Customers shall indemnify Studio22 Photobooks against any claims arising from copyright infringement or other legal violations.
6. Delivery Time
6.1. Standard production and delivery time is fifteen (15) working days from receipt of payment. However, delays beyond our control may occur, and Studio22 Photobooks is not liable for compensation due to late delivery.
6.2. Orders may be delayed or cancelled due to unforeseen circumstances (Force Majeure), including but not limited to strikes, natural disasters, and supply chain disruptions.
7. Third-Party Collections & Courier Responsibility
If a client arranges for any third party—such as a courier service, Uber driver, private individual, or company representative—to collect a completed order from our premises, Studio22 accepts no responsibility or liability for the item once it has been handed over.
It is the client’s sole responsibility to ensure the following:
- The person or courier collecting on your behalf is clearly identified and instructed properly.
- The collector knows the correct name of the person they are collecting for and what they are collecting.
- The collector is instructed to enter our premises and present themselves to our staff to collect the item. For legal and security reasons, we do not and will not hand over any package to an unidentified person waiting outside, in a vehicle, or “in the street”.
- If a collector is unknown to our staff and arrives without clear identification or instruction, we reserve the right to refuse handover of the package until verification is made.
Once a package is released to a third party, Studio22 cannot be held liable for any loss, damage, misdelivery, or disputes arising thereafter. This includes instances where a package is handed to the wrong person due to insufficient instruction, misidentification, or miscommunication by the client or their appointed collector.
Please ensure all collection arrangements are made responsibly and in writing where possible. If in doubt, we recommend collecting your order in person.
8. Guarantee and Complaints
8.1. Complaints about product quality or service must be submitted in writing within seven (7) days of receipt of the order.
8.2. If a replacement is required, the customer must return the product at their own expense within thirty (30) days of delivery.
8.3. Studio22 Photobooks does not provide refunds for rejected orders due to non-compliance with these terms and conditions.
9. Governing Law
9.1. These terms and conditions are governed by and construed in accordance with the laws of South Africa. Any disputes shall be resolved in a South African court of law.
By placing an order with Studio22 Photobooks, you acknowledge and agree to these terms and conditions.
